Waco police arrest man after multiple beer bottles found in vehicle following hit-and-run: Affidavit

WACO, Texas (KWTX) – A Waco man was arrested after police found several beer bottles in his vehicle following a hit-and-run crash, an affidavit states.

Juan Carlos Maldonado is accused of drunk driving, an accident involving personal injury and revenge.

On August 21, at approximately 8:47 p.m., police were called to the North Jack Kultgen southbound exit and South Martin Luther King Jr. Boulevard for a report of an injury accident.

When officers arrived on scene, they found Maldonado near a median at the Waco Fire Department, according to the affidavit.

Police spoke to a witness who said he saw Maldonado ram a vehicle and drive away, the affidavit said.

The witness said he chased Maldonado, eventually catching up with him and grabbing him, the affidavit states.

According to the affidavit, Maldonado drove off while the witness held on to him and shortly thereafter drove his truck into a median.

When police tried to speak to Maldonado, he began arguing with another witness, according to the affidavit, and officers could smell alcohol on his breath.

Police asked Maldonado if he had been drinking, to which he replied “no,” according to the affidavit.

According to the affidavit, Maldonado told police he was driving and someone performed a brake check.

Police asked Maldonado if he would be willing to take a breathalyzer test, and according to the affidavit, he agreed.

Police described Maldonado as failing several sobriety tests and said he was slurring his words during the conversation, the affidavit states.

Maldonado decided to abort the breathalyzer test and was subsequently arrested, the affidavit states.

Police went to Maldonado’s car and, according to the affidavit, found several bottles of Modelo in the bed of the car and a can of Modelo on the passenger side floor.

Maldonado was charged with drunk driving and an accident involving personal injury.

Maldonado was taken to the emergency room at Baylor Scott and White Hillcrest to obtain medical clearance for his detention following the previous incident, an affidavit states.

While a nurse attempted to take Maldonado’s blood pressure and other vitals, according to the affidavit, Maldonado began to move and attempted to get up from the chair, resisting the officer’s attempts to redirect him.

The affidavit states that another officer grabbed Maldonado by the shoulder and pushed him back into the chair.

According to the affidavit, Maldonado began saying that the officer’s arm was close to his face and the officer told Maldonado to calm down.

According to the affidavit, Maldonado then allegedly told the officer: “(swear word), I would kill you with my soul!”

Maldonado was charged with retaliation for the incident.
